Daniel Penny was arrested and released on $100,000 bail in relation to the death of Jordan Neely.
According to neighbors, Daniel Penny, now 24 years old, was a high school athlete who joined the Marines immediately after graduating. He reportedly lived in a van at one point.
After the subway chokehold incident involving Daniel Penny and Jordan Neely, Penny was taken into police custody but later released without charges.
Under New York law, the manslaughter charge against Daniel Penny will require a jury to determine whether he acted recklessly, thereby creating an unjustifiable risk of death that resulted in the subway chokehold killing of Jordan Neely.
A few days after the death of Jordan Neely, Daniel Penny's lawyers released a statement asserting that their client had no intention of causing harm to Mr. Neely.
